Kwan VP: - 8. In his submissions for the applicant in this appeal, Mr Foster Yim repeated arguments that have been ruled against him in the CA Judgment, mounted direct and collateral attacks on the Set Aside Decision for which leave to appeal was refused in the Refusal of Leave Decision, advanced arguments that are outside the scope of the remaining ground of appeal being Ground 5, and sought orders that are not mentioned in the notice of appeal. It is unacceptable for counsel to make submissions on appeal in this manner.
